THIRD AND FINAL READING - Bylaw 1 Electoral Wards

In accordance with the Education Act, the Board of Trustees is establishing Bylaw 1 Electoral Wards. 

 

FIRST READING for Bylaw 1 Electoral Wards was passed on February 5, 2020 as follows:

“THAT the Board of Trustees hereby gives FIRST READING to the proposed changes to “Board Policy 8 - Board Operations”, “Board Policy 13 - Bylaw and Policy Development”, and “Board Bylaw 1 - Electoral Wards”, and directs the Superintendent to proceed with consultation outlined under the proposed Section 1.8 of the draft ”Board Policy 13 - Bylaw and Policy Development”.”

 

SECOND READING for Bylaw 1 Electoral Wards was passed on March 18, 2020 as follows:

“THAT the Board of Trustees hereby gives SECOND READING to the proposed changes to “Board Policy 8 - Board Operations”, “Board Policy 13 - Bylaw and Policy Development”, and “Board Bylaw 1 - Electoral Wards”, and directs the Superintendent to proceed with consultation outlined under the proposed Section 1.8 of the draft ”Board Policy 13 - Bylaw and Policy Development”.”

 

While the electoral wards were previously established under Board Policy, the Education Act would see the establishment of Electoral Wards under Bylaw.  Further, as Clearview previously did not use bylaws, a process for development and consideration of bylaws is needed.

Readers may also note that when Clearview was established two small areas of Clearview were missed by Alberta Education at the time for ward boundaries, and so minor amendments are proposed to capture all areas of Clearview under the respective ward boundaries.

Under the PROPOSED Board Policy 13 Bylaw and Policy Development

"Section 1.8 Under normal circumstances, the following steps are to be followed for developing new BYLAWS or for revising existing BYLAWS:

1.8.1 Trustees and the administration will normally initiate bylaw development.  However, a need for new or revised bylaws may be identified by any group or individual and forwarded to the Superintendent.  The Superintendent may seek advice from the Board and/or from the Policy Committee before proceeding to make recommendations on revision of existing bylaws or draft new bylaws.

1.8.2 A draft copy of the bylaw is prepared by the Superintendent (or designate) and may be presented to the Policy Committee for its consideration.

1.8.3 Each reading of the bylaw can only be done once per month and must allow for at least three weeks between readings.

1.8.4 FIRST READING: Draft bylaws are approved by the Board for circulation and feedback.

1.8.5 Draft bylaws are then: posted on Clearview’s website, and E-mailed to all staff, school council chairs, and parents and legal guardians for input for at least two weeks.

1.8.6 Any feedback received would be considered by the Policy Committee.

1.8.7 SECOND READING: the draft would be approved and/or amended by the Board.

1.8.8 Draft bylaws are then: posted on Clearview’s website, and E-mailed to all staff, school council chairs, and parents and legal guardians for input for at least two weeks.

1.8.9 Any feedback received would be considered by the Policy Committee.

1.8.10 THIRD READING: The final draft is then presented to the Board for approval.  

1.8.11 Bylaws become effective upon adoption or at a later date set by the Board.     

1.8.12 Bylaws, and accompanying policies and/or administrative procedures, shall be posted on Clearview’s website."
